Summary
House Bill 31 of the 148th General Assembly was passed by both chambers of the legislature, wherein the Charter of the Town of Laurel was amended to require that candidates for the Mayor and Town Councilpersons be a town resident for a minimum period of 1 year. HB 31 also added the qualification that candidates may not have been convicted of a felony, and each candidate running for office must submit a full background check conducted by the Delaware State Police. This bill repeats the 1 year residency requirement, but limits the felony prohibition to those that were not pardoned and specifically includes any other crime that would disqualify the person from holding an office of trust, honor or profit under Article II, Section 21 of the Delaware Constitution. The background check requirement is not included in this bill, but the candidate filing form must now be notarized and include an affirmation that the candidate meets all of the qualifications for office.
