AN ACT REQUIRING MUNICIPALITIES WITH HIGH POPULATION DENSITIES TO AUTHORIZE THE ISSUANCE AND RENEWAL OF PERMITS FOR THE SALE OF ALCOHOLIC LIQUOR.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective January 1, 2016) The Department of Consumer Protection shall not grant or renew a permit for the sale of alcoholic liquor in a municipality having a population density of more than six thousand persons per square mile, as enumerated in the most recent federal decennial census of the population, unless the legislative body of the municipality has, by a favorable vote of its legislative body, determined that: (1) The number of alcoholic liquor permit premises in the municipality is such that the granting or renewal of the permit is not detrimental to the public interest, considering the character, population, number of like permits and number of all permits existent in the municipality and the effect which the new or renewed permit may have on the municipality, and (2) for permit renewals, the permit premises has not been operated in a manner that has negatively impacted public health or safety.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To protect the public by requiring the legislative body of high population density municipalities to make certain determinations prior to the Department of Consumer Protection issuing or renewing a permit for the sale of alcoholic liquor.
