AN ACT CONCERNING MEDICAL ASSISTANTS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) (a) For purposes of this section:

(1) "Medical assistant" means a person who (A) is certified by the American Association of Medical Assistants, (B) has graduated from a postsecondary medical assisting program accredited by the Commission on Accreditation of Allied Health Education Programs, the Accrediting Bureau of Health Education Schools or the Accrediting Council for Independent Colleges and Schools, and (C) has successfully completed at least seven hundred twenty hours of training in medical assisting at a program described in this subdivision that includes an externship at an outpatient clinic of not less than one hundred sixty hours;

(2) "Physician" means a person authorized to practice medicine or osteopathy under chapter 370 of the general statutes; and

(3) "Outpatient clinic" means a clinic licensed under section 19a-493c of the general statutes.

(b) On and after January 1, 2015, any physician may delegate to a medical assistant the administration of medication orally, by inhalation or by intramuscular, intradermal or subcutaneous injection, including, but not limited to, the administration of a vaccine. Any medication administered by a medical assistant shall: (1) Be administered at an outpatient clinic or physician's office; (2) be administered under the direct supervision, control and responsibility of a physician who is in the outpatient clinic or office when such medication is administered; (3) for the administration of medication by injection, be limited to an injection in the extremities or the back of the patient; (4) not include the administration of an anesthetic agent or a schedule I, II or III controlled substance or the administration of medication by intravenous injection; and (5) be administered by a medical assistant whom the supervising physician reasonably believes has the skill and competency to administer such medication. A medical assistant shall not administer medication (A) in an inpatient clinic, hospital emergency department or ambulatory surgical center, or (B) during routine surgical procedures in an outpatient clinic or physician's office.

This act shall take effect as follows and shall amend the following sections:
