AN ACT CONCERNING THE SHACKLING OF CHILDREN DURING DELINQUENCY PROCEEDINGS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That chapter 815t of the general statutes be amended to prohibit the physical restraining of a child, as defined in section 46b-120 of the general statutes, by the use of shackles, handcuffs or other mechanical restraint, at any delinquency proceeding prior to conviction, unless a judge determines that the restraining of an individual child is necessary to ensure public safety. Nothing in this section shall be construed as preventing a child from being physically restrained while being transported from one location to another.
Statement of Purpose:
To prohibit children from being mechanically restrained during delinquency proceedings prior to conviction, unless necessary to ensure public safety.
