AN ACT LIMITING NONECONOMIC DAMAGES IN MEDICAL MALPRACTICE ACTIONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-572h of the general statutes be amended to provide that in civil actions, whether in tort or in contract, to recover damages resulting from personal injury or wrongful death in which it is alleged that such injury or death resulted from the negligence of a health care provider, no claimant may be awarded more than two hundred fifty thousand dollars for noneconomic damages.

Statement of Purpose:

To reduce health care costs and provide professional liability insurance premium relief to health care providers by limiting the amount of noneconomic damage awards in medical malpractice actions.
