AN ACT CONCERNING A SURETY BOND GUARANTEE PROGRAM FOR EMERGING CONTRACTORS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) (a) As used in this section:

(1) "Emerging contractor" means a contractor who (A) has not been prequalified pursuant to section 4a-100 of the general statutes, and (B) is unable to obtain bonding required under section 49-41 of the general statutes to bid on a contract or perform work pursuant to a contract for the construction, reconstruction, alteration, remodeling, repair or demolition of any public building or any other public work by the state or a municipality, except a public highway or bridge project or any other construction project administered by the Department of Transportation; and

(2) "Contract" means an agreement for work for the state or a municipality that is estimated to cost more than five hundred thousand dollars and is funded, in whole or in part, by state funds.

(b) Not later than February 1, 2013, the Commissioner of Administrative Services, in consultation with the Commissioners of Construction Services, Transportation and Economic and Community Development, and the Labor Commissioner, or their designees, shall submit a report, in accordance with section 11-4 of the general statutes, to the joint standing committee of the General Assembly having cognizance of matters relating to labor and public employees. Such report shall include an analysis of the feasibility of: (1) Alleviating, for emerging contractors, the bond requirements of sections 4a-100 and 49-41 of the general statutes, and (2) establishing a surety bond program to assist emerging contractors to more effectively compete for public works contracts.

This act shall take effect as follows and shall amend the following sections:
