AN ACT CONCERNING USE OF THE TERM "ASSISTED LIVING".

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2010) (a) No entity shall use the term "assisted living" in its name, title, advertising or other communication with the public unless such entity: (1) Owns, operates or manages a managed residential community pursuant to chapter 368bb of the general statutes where assisted living services are provided to residents by an assisted living services agency licensed pursuant to chapter 368v of the general statutes and in accordance with regulations adopted by the Commissioner of Public Health; or (2) owns, operates or manages an assisted living services agency licensed pursuant to said chapter 368v.

(b) A violation of subsection (a) of this section shall be deemed an unfair trade practice under subsection (a) of section 42-110b of the general statutes.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To protect consumers by ensuring that entities are not allowed to use the term "assisted living" in communications to the public unless the assisted living services are provided by licensed personnel.
