AN ACT PERMITTING A COMMUNITY SPOUSE OF AN INSTITUTIONALIZED SPOUSE TO RETAIN THE MAXIMUM AMOUNT OF ALLOWABLE ASSETS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
Section 1. (NEW) (Effective from passage) (a) For purposes of this section:
(1) "Institutionalized spouse" has the same meaning as provided in 42 USC 1396r-5(h)(1).
(2) "Community spouse" has the same meaning as provided in 42 USC 1396r-5(h)(2).
(b) The Commissioner of Social Services shall amend the Medicaid state plan to permit a community spouse of an institutionalized spouse to retain the maximum community spouse resource allowable for such community spouse pursuant to 42 USC 1396r-5(f)(2).
(c) The commissioner shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to implement the provisions of this section.
This act shall take effect as follows and shall amend the following sections: | ||
