AN ACT CONCERNING DOCUMENTATION OF LICENSING FOR WORKERS HIRED TO REPLACE STRIKING OR LOCKED-OUT HEALTH CARE EMPLOYEES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 31-121a of the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

(a) In the event of a strike, work stoppage or lockout involving employees of a health care institution licensed by the Department of Public Health under sections 19a-490 to 19a-503, inclusive, the Labor Commissioner shall, upon the request of either party to such labor dispute, appoint an impartial fact-finder if [he] the commissioner determines that such dispute is endangering or may endanger the health, welfare and safety of the patients of the institution or the general community. The fact-finder shall inquire into the causes and effects of the dispute and shall issue a report of his or her findings to the [Labor Commissioner] commissioner and the parties, including nonbinding recommendations for settlement of the dispute. The cost of the fact-finder shall be shared equally by both parties.

(b) Any person hired by a health care institution, as described in subsection (a) of this section, to replace an employee who is absent due to a strike, work stoppage or lockout shall provide a copy of a valid license or certification that permits such person to work in the capacity for which such person has been hired by the health care institution to the Commissioners of Public Health and Social Services prior to commencing employment with the health care institution.

This act shall take effect as follows and shall amend the following sections:
