AN ACT CONCERNING IMMUNITY FOR REPORTING A DRUG OVERDOSE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to provide that a person who, in good faith, seeks medical assistance for another person who is experiencing a drug-related overdose shall not be charged or prosecuted for the illegal possession of a controlled substance in violation of section 21a-279 of the general statutes if evidence of such violation is obtained as a result of the seeking of such medical assistance, provided such immunity shall not preclude the use of such evidence to charge and prosecute such person for the illegal sale, manufacture or distribution of a controlled substance in violation of section 21a-277 or 21a-278 of the general statutes.

Statement of Purpose:

To encourage persons to call for assistance on behalf of persons suffering from a drug overdose.
