AN ACT CONCERNING THE ESTABLISHMENT OF A COMMUNITY SERVICE REQUIREMENT FOR THOSE SEEKING FEE WAIVERS IN CIVIL ACTIONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-259b of the general statutes be amended to provide that any individual seeking a waiver of fees payable to the court or costs associated with service of process for a lawsuit involving money damages shall be required to perform community service in lieu of the payment of such fee unless the court determines that the individual seeking such waiver is unable to perform such service.

Statement of Purpose:

To minimize frivolous litigation that is attributable to abuse of the fee waiver provisions found in 52-259b of the general statutes.
