AN ACT AUTHORIZING AN INCREASE IN THE MAXIMUM AMOUNT OF HAZARDOUS WASTE STORED AT CERTAIN COMMERCIAL FACILITIES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2015) (a) For purposes of this section, "generator", "hazardous waste" and "on-site" shall each have the same meaning as provided for in 40 CFR 260.10 and "generates", "permit" and "interim status" shall each have the same meaning as used in 40 CFR 262.34.

(b) Notwithstanding the provisions of subparagraph (O) of subdivision (2) of subsection (a) of section 22a-449c-102 of the regulations of Connecticut state agencies, a generator who generates greater than one hundred kilograms but less than one thousand kilograms of hazardous waste in a calendar month may accumulate hazardous waste on-site for one hundred eighty days or less without a permit or without having interim status provided the quantity of waste accumulated on-site never exceeds six thousand kilograms.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To allow certain generators of hazardous waste to store six thousand kilograms of hazardous waste on-site during a six-month period, in accordance with federal regulations, rather than the current one-thousand-kilogram limit established under state regulations.
