AN ACT PERMITTING A PRIVATE HOMEOWNER TO BRING AN ACTION IN THE SUPERIOR COURT AGAINST THE STATE FOR FLOOD DAMAGES CAUSED BY THE STATE'S FAILURE TO PROPERLY MAINTAIN A STATE ROAD.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That, notwithstanding any provision of the general statutes, the General Assembly may authorize a private homeowner residing on state Route 122 in New Haven to sue the state for flood damages caused to the residence of such homeowner, which damages were caused by the state's failure to properly maintain a state road.

Statement of Purpose:

To allow a private homeowner to sue the state for flood damages incurred because of the state's failure to properly maintain a state road.
