AN ACT CONCERNING THE RIGHT OF A FORMER OWNER OF REAL PROPERTY TO REPURCHASE THE REAL PROPERTY WHEN TAKEN BY THE STATE THROUGH EMINENT DOMAIN.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That title 48 of the general statutes be amended to provide that when the state takes real property from a person through eminent domain and the real property is not being used for the purpose for which it was taken, the state shall first offer the real property for sale to the person from whom the real property was acquired at a price not to exceed the amount paid by the state.

Statement of Purpose:

To give a former owner of real property taken by the state through eminent domain the opportunity to buy back the real property when the property is not being used by the state for the purpose for which it was taken.
