AN ACT CONCERNING THE EVIDENTIARY STANDARD FOR PUNITIVE DAMAGE AWARDS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That chapter 901 of the general statutes be amended to require a plaintiff to establish, by clear and convincing evidence, that a defendant acted in a wanton manner in order to recover punitive damages.
Statement of Purpose:
To reform the tort system by requiring a plaintiff to establish, by clear and convincing evidence, that a defendant acted in a wanton manner in order to recover punitive damages.
