An act to amend Section 339.5 of the Code of Civil Procedure, relating to civil actions.


LEGISLATIVE COUNSEL'S DIGEST


SB 901, as introduced, Umberg. Civil actions: time for commencement: unwritten lease.
Existing law prohibits an action for breach of an unwritten lease of real property from being brought more than 2 years after breach of the lease and abandonment of the property, or more than 2 years after termination of the right of the lessee to possession of the property, whichever is the earlier time.
This bill would make technical, nonsubstantive changes to this provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 339.5 of the Code of Civil Procedure is amended to read:

339.5.
 Where a lease of real property is not in writing, no an action shall not be brought under Section 1951.2 of the Civil Code more than two years after the breach of the lease and abandonment of the property, or more than two years after the termination of the right of the lessee to possession of possess the property, whichever is the earlier time.
