An act to amend Section 66028 of 66025 of, and to add Sections 66020.9 and 66201.6 to, the Education Code, relating to public postsecondary education.

Existing law, the Donahoe Higher Education Act, among other things, sets forth the missions and functions of the 3 segments of public postsecondary education in this state: the University of California, under the administration of the Regents of University of California; the California State University, under the administration of the Trustees of the California State University; and the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges. The Working Families Student Fee Transparency and Accountability Act, which is a part of the Donahoe Higher Education Act, establishes various policies relating to student fees and student financial aid at the University of California and the California State University.
Provisions of the Donahoe Higher Education Act are applicable to the University of California only to the extent that the regents act, by resolution, to make them applicable.
This bill would make a nonsubstantive change in a provision of the Working
Families Student Fee Transparency and Accountability Act.
This bill would add a provision to the Donahoe Higher Education Act that would prohibit the California State University from providing, and, notwithstanding any other law, as a condition for the expenditure of funds appropriated in the annual Budget Act, prohibit the University of California from providing, state-funded financial assistance to an undergraduate student who, in the absence of financial assistance, is statutorily required to pay tuition or any mandatory fee at a rate higher than a California resident.
The bill would add a provision to the Donahoe Higher Education Act that would require the California State University, and, notwithstanding any other law, as a condition for the expenditure of funds appropriated in the annual Budget Act, require the
University of California, to refrain from increasing the total amount of tuition and mandatory systemwide fees charged to undergraduate students from the 2018–19 academic year to the 2022–23 academic year, inclusive.
The bill would add a provision to the Donahoe Higher Education Act that, for the 2019–20 academic year, and for each academic year thereafter, would prohibit out-of-state undergraduate students of the California State University from constituting either more than 10% of the incoming undergraduate class or more than 10% of the total undergraduate enrollment at each campus in the California State University system. The bill, notwithstanding any other law, and as a condition for the expenditure of funds appropriated in the annual Budget Act, would also add a provision prohibiting out-of-state undergraduate students of the University of California from constituting more than 10% of the incoming undergraduate class or more than 10% of the total undergraduate
enrollment at each campus in the University of California system. The bill would define “out-of-state undergraduate student” for these purposes.

The people of the State of California do enact as follows:
SECTION 1.
Section 66020.9 is added to the Education Code, to read:66020.9.
Notwithstanding Section 67400 or any other law, the California State University shall not provide, and, as a condition for the expenditure of funds appropriated in the annual Budget Act, the University of California shall not provide, state-funded financial assistance to an undergraduate student who, in the absence of financial assistance, is statutorily required to pay tuition or any mandatory fee at a rate higher than a California resident.SEC. 2.
Section 66025 of the Education Code is amended to read:66025.
(a) Systemwide fees charged to resident undergraduate students at the University of California and the California State University shall be reduced for the 1998–99 fiscal year by 5 percent below the level charged during the 1997–98 fiscal year, and the systemwide fees charged to those students for the 1999–2000 fiscal year shall be reduced by 5 percent below the level charged during the 1998–99 fiscal year. Systemwide education and registration fees charged to resident graduate students at the University of California and the California State University for the 1999–2000 fiscal year shall be reduced by 5 percent below the level charged those resident students for the 1997–98 fiscal year. This subdivision does not apply to resident students pursuing a course of study leading to a professional degree who are subject to a supplemental fee pursuant to the policy of the University of California.(b)No provision of this section shall apply to the University of California except to the extent that the Regents of the University of California, by appropriate resolution, make that provision applicable.
(b) Notwithstanding Section 67400 or any other law, the California State University shall not increase, and, as a condition for the expenditure of funds appropriated in the annual Budget Act, the University of California shall not increase, the total amount of tuition and mandatory systemwide fees charged to undergraduate students of their
respective segments from the 2018–19 academic year to the 2022–23 academic year, inclusive.
SEC. 3.
Section 66201.6 is added to the Education Code, to read:66201.6.
(a) Notwithstanding Section 67400 or any other law, for the 2019–20 academic year, and for each academic year thereafter, out-of-state undergraduate students shall constitute not more than 10 percent of the incoming undergraduate class, and not more than 10 percent of the total undergraduate enrollment, at each campus in the California State University system, and, as a condition for the expenditure of funds appropriated in the annual Budget Act, out-of-state undergraduate students shall constitute not more than 10 percent of the incoming undergraduate class, and not more than 10 percent of the total undergraduate enrollment, at each campus in the University of California system.(b) For purposes of this section, an “out-of-state
undergraduate student” is an undergraduate student whose residence was outside of California at the time he or she applied for admission to the California State University or the University of California, as appropriate.
This article shall be known as, and may be cited as, the Working Families Student Fee Transparency and Accountability Act.
