   An act to add Section  20112.5   20102.5
 to the Public Contract Code, relating to public contracts.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1347, as amended, Anderson. Public contracts: school 
districts.   districts: charter schools. 
   The Local Agency Public Construction Act establishes contracting
by local agencies for the construction of public works. 
Existing law regulates the procedures by which a school district
awards public works contracts.  
   This bill would require a school district, at the next regular
update of its Internet Web site, to post on that site a copy of any
final public works contract awarded at a cost of $5,000 or more. By
imposing an additional duty upon school districts in the posting of
public works contracts, this bill would impose a state-mandated local
program.  
   This bill would require a school district or charter school to
annually post on its Internet Web site a list of any contracts for
the construction of a public work or improvement involving an
expenditure of more than $15,000 that was awarded in the prior
calendar year, and would require the list to contain specified
information. By imposing an additional duty upon school districts and
charter schools in the posting of public works contracts, this bill
would impose a state-mandated local program. 
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.
   Vote: majority. Appropriation: no. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
   
  SECTION 1.    Section 20112.5 is added to the
Public Contract Code, to read:
   20112.5.  A school district subject to this article that is taking
bids for the construction of a public work or improvement costing
five thousand dollars ($5,000) or more shall, at the next regular
update of the school district's Internet Web site, post on that site
a copy of each final contract awarded. 
   SECTION 1.    Section 20102.5 is added to the 
 Public Contract Code   , to read:  
   20102.5.  (a) A school district or charter school subject to this
chapter shall annually post on its Internet Web site a list of any
contracts for the construction of a public work or improvement
involving an expenditure of more than fifteen thousand dollars
($15,000) that was awarded in the prior calendar year.
   (b) The list shall contain the following information:
   (1) The type of contract.
   (2) The amount of the contract.
   (3) The entity that was awarded the contract.
   (4) The award date of the contract. 
  SEC. 2.  If the Commission on State Mandates determines that this
act contains costs mandated by the state, reimbursement to local
agencies and school districts for those costs shall be made pursuant
to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of
the Government Code.
