   An act to amend Section 35350 of the Education Code, relating to
pupil transportation.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1225, as introduced, Wright. Pupil transportation: pupil
safety.
   Existing law prohibits a governing board of a school district from
requiring the transportation of a student or pupil for any purpose
or for any reason without the written permission of the parent or
guardian unless there is an emergency arising from illness or injury
to the student or pupil.
   This bill would also authorize the transportation of a pupil
without the written permission of the parent or guardian in situation
that requires the immediate transportation of the pupil to ensure
his or her safety. The bill would also make nonsubstantive changes to
this provision.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 35350 of the Education Code is amended to read:

   35350.   No   (a)     The
 governing board of a school district shall  not 
require  any student or   a  pupil to be
transported for any purpose or for any reason without the written
permission of the parent or guardian. 
   This 
    (b)     This  section shall not apply
to the transportation of a  student or  pupil in an
emergency arising from illness or injury to the  student or
 pupil  , or in a situation that requires the immediate
transportation of the pupil to ensure his or her safety  .
