LEGISLATIVE COUNSEL'S DIGEST
The Planning and Zoning Law authorizes the legislative body of any county or city to adopt an ordinance that regulates the use of buildings, structures, and land. Existing law prohibits the imposition of parking standards for multifamily housing developments that are subject to a streamlined, ministerial approval process, except under limited circumstances.
This bill would prohibit a city, county, or city and county from imposing minimum parking requirements for new housing developments where offstreet parking is permitted. By imposing new requirements on local agencies, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish
procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
