Existing law, the Song-Brown Family Physician Training Program, is a state medical contract program with medical schools, programs that train primary care physician’s assistants, programs that train primary care nurse practitioners, hospitals, and other health care delivery systems that is intended to increase the number of students and residents receiving quality education and training in the specialty of family practice and to maximize the delivery of primary care family physician services to areas of California where there is a recognized unmet priority need for those services. Existing law requires the Office of Statewide Health Planning and Development, among other duties, to provide long-term stability and non-General Fund support for these programs, and to report on these strategies to the legislative budget committees.
This bill would create the continuously appropriated California Healthcare Workforce Training Tax Revenue Fund and would require all revenues appropriated or otherwise provided to the Office of Statewide Health Planning and Development from the tax revenues generated from a proposed nicotine-content-based e-cigarette tax to be deposited into the fund. The bill would require all revenues in the fund to be used solely for purposes of the Song-Brown Family Physician Training Program, as specified, and would require those revenues to be used to supplement, and not to supplant, funds from other sources provided for purposes of the program. By creating a continuously appropriated fund, the bill would make an appropriation.

Under existing law, the Medically Underserved Account for Physicians is established within the Health Professions Education Fund for purposes of providing funding for the ongoing operations by the Health Professions Education Foundation of the Steven M. Thompson Physician Corps Loan Repayment Program, the Physician Volunteer Program, and other specified activities.

Existing law regulates the sale and taxation of various tobacco products, including electronic cigarettes, also known as e-cigarettes. Under existing law, an e-cigarette is a type of device or delivery system sold in combination with nicotine which can be used to deliver to a person nicotine in aerosolized or vaporized form.

This bill would declare the intent of the Legislature to enact legislation to appropriate a percentage of the tax revenues generated from proposed increased taxation on e-cigarettes, and to deposit those moneys into the Medically Underserved Account for Physicians.

The people of the State of California do enact as follows:


SECTION 1.

 Section 128242 is added to the Health and Safety Code, to read:

128242.
 (a) The California Healthcare Workforce Training Tax Revenue Fund is hereby established.
(b) All revenues appropriated or otherwise provided to the Office of Statewide Health Planning and Development from the tax revenues generated from the proposed nicotine-content-based e-cigarette tax shall be deposited into the California Healthcare Workforce Training Tax Revenue Fund.
(c) Notwithstanding any other law, the California Healthcare Workforce Training Tax Revenue Fund is established solely to increase the awards granted to accredited medical schools, teaching health centers, programs that train primary care physician assistants, primary care nurse practitioners, and primary care registered nurses for the purposes of this article. All revenues deposited into the California Healthcare Workforce Training Tax Revenue Fund, together with interest earned by the fund, are hereby continuously appropriated for the purposes of this article without regard to fiscal year and shall be expended only in accordance with the provisions of this article and its purposes.
(d) Revenues deposited into the California Healthcare Workforce Training Tax Revenue Fund pursuant to this section shall be used to supplement, and not to supplant, funds from other sources provided for purposes of this article.

SECTION 1.Section 128552.5 is added to the Health and Safety Code, to read:
128552.5.

It is the intent of the Legislature to enact legislation to appropriate a percentage of the tax revenues generated from the proposed increased taxation on e-cigarettes, and to deposit those moneys into the Medically Underserved Account for Physicians in the Health Professions Education Fund.
