An act to amend Section 33190 of add and repeal Section 33194 of the Education Code, relating to private school instruction. schools.

Existing law generally requires each person between 6 and 18 years of age to attend the public full-time day school or continuation school in the school district in which the residency of his or her parent or legal guardian is located. Existing law provides various exemptions to this requirement, including an exemption for children who are being instructed in a private full-time day school by persons capable of teaching, as specified.
Existing law requires every person, firm, association, partnership, or corporation offering or conducting private school instruction on the elementary or high school level to file with the Superintendent of Public Instruction an affidavit or statement, under penalty of perjury, by the owner or other head setting forth specified information relating to the private school, as provided.

This bill would make nonsubstantive changes to this law.

This bill would require the Superintendent to establish a broadly representative and diverse advisory committee to advise the Superintendent and the State Board of Education on all appropriate matters relative to home schools, which the bill would define. The bill would require the advisory committee, on or before July 1, 2020, to make recommendations to the Superintendent and state board on the appropriateness and feasibility of imposing additional requirements, as provided, on home schools. The bill would require the Superintendent and state board, on or before January 1, 2021, in consultation with the advisory committee, to make recommendations to the Legislature and the Governor relating to imposing additional requirements on home schools. The bill would require the State Department of Education to provide staff for the advisory committee. The bill would repeal these provisions on January 1, 2022.

The people of the State of California do enact as follows:


SECTION 1.

 Section 33194 is added to the Education Code, to read:

33194.
 (a) For purposes of this section, “home school” means a private school operated by a parent, guardian, or other individual in a home environment that provides instruction at the level of kindergarten or any of grades 1 to 12, inclusive.
(b) The Superintendent shall establish a broadly representative and diverse advisory committee to advise the Superintendent and the state board on all appropriate matters relative to home schools. A member of the advisory committee shall serve without compensation for a term not to exceed two years. The department shall provide staff for the advisory committee.
(c) On or before July 1, 2020, the advisory committee established pursuant to subdivision (b) shall make recommendations to the Superintendent and the state board on the appropriateness and feasibility of imposing on a home school additional requirements, which shall include, but are not limited to, all of the following:
(1) Health and safety inspections.
(2) Additional, specific curriculum standards.
(3) Certification or credentialing of teachers.
(d) On or before January 1, 2021, the Superintendent and the state board, in consultation with the advisory committee established pursuant to subdivision (b), shall make recommendations to the Legislature, in compliance with Section 9795 of the Government Code, and the Governor relating to imposing additional requirements on home schools, as described in subdivision (c).
(e) This section shall remain in effect only until January 1, 2022, and as of that date is repealed.

SECTION 1.Section 33190 of the Education Code is amended to read:
33190.

(a)Each person, firm, association, partnership, or corporation offering or conducting private school instruction on the elementary or high school level shall between the first and 15th day of October of each year, file with the Superintendent an affidavit or statement, under penalty of perjury, by the owner or other head setting forth the following information for the current year:

(1)All names, whether real or fictitious, of the person, firm, association, partnership, or corporation under which it has done and is doing business.

(2)The address, including city and street, of every place of doing business of the person, firm, association, partnership, or corporation within the State of California.

(3)The address, including city and street, of the location of the records of the person, firm, association, partnership, or corporation, and the name and address, including city and street, of the custodian of such records.

(4)The names and addresses, including city and street, of the directors, if any, and principal officers of the person, firm, association, partnership, or corporation.

(5)The school enrollment, by grades, number of teachers, coeducational or enrollment limited to boys or girls, and boarding facilities.

(6)That the following records are maintained at the address stated, and are true and accurate:

(A)The records required to be kept by Section 48222.

(B)The courses of study offered by the institution.

(C)The names and addresses, including city and street, of its faculty, together with a record of the educational qualifications of each.

(7)Criminal record summary information has been obtained pursuant to Section 44237.

(b)Whenever two or more private schools are under the effective control or supervision of a single administrative unit, the administrative unit may comply with this section on behalf of each of the schools under its control or supervision by submitting one report.

(c)Filing pursuant to this section shall not be interpreted to mean, and it shall be unlawful for a school to expressly or impliedly represent by any means whatsoever, that the State of California, the Superintendent, the state board, the department, or any division or bureau of the department, or any accrediting agency has made any evaluation, recognition, approval, or endorsement of the school or course unless this is an actual fact.

(d)The Superintendent shall prepare and publish a list of private elementary and high schools to include the name and address of the school and the name of the school owner or administrator.
