An act to add and repeal Section 5007.8 to of the Public Resources Code, relating to fire prevention.

AB 2896, as amended, Kiley. Fire prevention: state parks: fire hazard reduction.
Existing law requires a person who owns, leases, controls, operates, or maintains an occupied dwelling or occupied structure in, upon, or adjoining a mountainous area, forest-covered land, brush-covered land, grass-covered land, or land that is covered with flammable material within a very high fire hazard severity zone to at all times maintain defensible space of 100 feet from each side and from the front and rear of the structure, as provided. Existing law establishes in the Natural Resources Agency vests control of the state park system with the Department of Parks and Recreation. Existing law provides that the department has the right to remove and dispose of debris deposited on public beaches, waterways, or lands within the state park system when the deposits create a hazard or impediment to public safety, enjoyment, and use of the public beach, waterway, or land.
This bill would would, until January 1, 2023, require the department, within 90 days of receiving a upon request by a private property owner or by an agency of local government or a local official, to reduce surface fuels or other fire hazards on the department’s property that are within 300 feet of a structure on the land of the property owner or local government, as provided. The bill would require the department to consult with department, in consultation with the Department of Forestry and Fire Protection Protection, to determine the necessary amount of surface fuel or fire hazard reduction work. work, as prescribed.

The people of the State of California do enact as follows:


SECTION 1.

 Section 5007.8 is added to the Public Resources Code, to read:

5007.8.
 (a) The department, within 90 days of receiving a upon request by a private property owner or by any agency of local government or any local official, shall reduce surface fuels or other fire hazards on the department’s property that are within 300 feet of a structure on the land of the property owner or local government.
(b) Before reducing the surface fuels or other fire hazards pursuant to subdivision (a), the department department, in consultation with the Department of Forestry and Fire Protection, shall consult with the Department of Forestry and Fire Protection to determine the necessary amount of surface fuel or fire hazard reduction work.
(c) (1) A private property owner may request this service no more than once every 360 days. year.
(2) An agent of local government may request this service in relation to a particular structure on local government land no more than once every 360 days. year.
(d) This section shall apply only to state parks or state recreation areas located wholly or partially within a state responsibility area, as defined in Section 4102.
(e) The department shall complete all necessary surface fuel or fire hazard reduction work required by this section within 90 days after issuance of any necessary permits to conduct the work.
(f) This section shall remain in effect only until January 1, 2023, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2023, deletes or extends that date.
