An act to amend Section 1653.5 of, and to add Section 1808.26 to, the Vehicle Code, relating to the Department of Motor Vehicles.

Existing law authorizes the governing board of a community college district to enter into a College and Career Access Pathways partnership with the governing board of a school district with the goal of developing seamless pathways from high school to community college for career technical education or preparation for transfer, improving high school graduation rates, or helping high school pupils achieve college and career readiness.

Existing federal and state law provides for the confidentiality of specified personal information, including an individual’s name, address, and telephone number, provided to the Department of Motor Vehicles and prohibits the disclosure of that information, except as specified. Existing law specifies that information regarding an applicant’s social security account number, obtained by the department for purposes of obtaining a driver’s license or identification ~~card~~ card, is not a public record and prohibits disclosure by the department except for specified purposes, including responding to information requests from the Franchise Tax Board for the purpose of tax administration.

This bill would require the Department of Motor Vehicles to enter into an interagency agreement with the Employment Development Department, the California Community Colleges, and the State Department of Education to assist those entities in identifying students who participate in career technical education programs, so that those entities may be able to measure the employment outcomes of those students and recommend how those programs may be improved. The bill would prohibit ~~the information~~ a social security number made available by the department pursuant to that ~~provision~~ agreement from constituting a public record or being used for any other purpose. The bill would add the purposes of the interagency agreement established pursuant to these provisions to the list of purposes for which the department may disclose social security numbers.

Existing constitutional provisions require that a statute that limits the right of access to the meetings of public bodies or the writings of public officials and agencies be adopted with findings demonstrating the interest protected by the limitation and the need for protecting that interest.
This bill would make legislative findings to that effect.

The people of the State of California do enact as follows:

SECTION 1.

Section 1653.5 of the Vehicle Code, as amended by Section 2 of Chapter 452 of the Statutes of 2014, is amended to read:

1653.5.

(a) Each form prescribed by the department for use by an applicant for the issuance or renewal by the department of a driver’s license or identification card pursuant to Division 6 (commencing with Section 12500) shall contain a section for the applicant’s social security account number.

(b) Each form prescribed by the department for use by an applicant for the issuance, renewal, or transfer of the registration or certificate of title to a vehicle shall contain a section for the applicant’s driver’s license or identification card number.

(c) Except as provided in Section 12801, a person who submits to the department a form that, pursuant to subdivision (a), contains a section for the applicant’s social security account number, or pursuant to subdivision (b), the applicant’s driver’s license or identification card number, if any, shall furnish the appropriate number in the space provided.

(d) Except as provided in Section 12801, the department shall not complete an application that does not include the applicant’s social security account number or driver’s license or identification card number as required under subdivision (c).

(e) An applicant’s social security account number shall not be included by the department on a driver’s license, identification card, registration, certificate of title, or any other document issued by the department.

(f) Notwithstanding any other law, information regarding an applicant’s social security account number, or ineligibility for a social security number, obtained by the department pursuant to this section, is not a public record and shall not be disclosed by the department except for any of the following purposes:

(1) Responding to a request for information from an agency operating pursuant to, and carrying out the provisions of, Part A (Block Grants to States for Temporary Assistance for Needy Families), or Part D (Child Support and Establishment of Paternity), of Subchapter IV of Chapter 7 of Title 42 of the United States Code.

(2) Implementation of Section 12419.10 of the Government Code.

(3) Responding to information requests from the Franchise Tax Board for the purpose of tax administration.

(4) For purposes of the interagency agreement with the Employment Development Department, the California Community Colleges, and the State Department of Education pursuant to Section 1808.26.

(g) This section shall become operative on January 1, 2015, or on the date that the director executes a declaration pursuant to Section 12801.11, whichever is sooner.

(h) This section shall become inoperative on the effective date of a final judicial determination made by any court of appellate jurisdiction that any provision of the act that added this section, or its application, either in whole or in part, is enjoined, found unconstitutional, or held invalid for any reason. The department shall post this information on its Internet Web site.

SEC. 2.

Section 1653.5 of the Vehicle Code, as amended by Section 168 of Chapter 71 of the Statutes of 2014, is amended to read:

1653.5.

(c) A person who submits to the department a form that, pursuant to subdivision (a), contains a section for the applicant’s social security account number, or pursuant to subdivision (b), the applicant’s driver’s license or identification card number, if any, shall furnish the appropriate number in the space provided.

(d) The department shall not complete an application that does not include the applicant’s social security account number or driver’s license or identification card number as required under subdivision (c).

(f) Notwithstanding any other law, information regarding an applicant’s social security account number, obtained by the department pursuant to this section, is not a public record and shall not be disclosed by the department except for any of the following purposes:

(2) Implementation of Section 12419.10 of the Government Code.

(3) Responding to information requests from the Franchise Tax Board for the purpose of tax administration.

(4) For purposes of the interagency agreement with the Employment Development Department, the California Community Colleges, and the State Department of Education pursuant to Section 1808.26.

(g) This section shall become operative on the effective date of a final judicial determination made by any court of appellate jurisdiction that any provision of the act that added this section, or its application, either in whole or in part, is enjoined, found unconstitutional, or held invalid for any reason. SEC. 3.

Section 1808.26 is added to the Vehicle Code, to read:

1808.26.

Notwithstanding any other law, the department shall enter into an interagency agreement with the Employment Development Department, the California Community Colleges, and the State Department of Education to assist those entities in identifying students who participate in career technical education programs, so that those entities may be able to measure the employment outcomes of those students and recommend how those programs may be improved. ~~Information~~ Social security numbers made available by the department pursuant to this section are not public records and shall not be used for any other purpose.

SEC. 4.
The Legislature finds and declares that Section 3 of this act, which adds Section 1808.26 to the Vehicle Code, imposes a limitation on the public’s right of access to the meetings of public bodies or the writings of public officials and agencies within the meaning of Section 3 of Article I of the California Constitution. Pursuant to that constitutional provision, the Legislature makes the following findings to demonstrate the interest protected by this limitation and the need for protecting that interest:
In order to protect private and confidential personal information, it is necessary for that information to remain confidential.
