An act to amend Section 500 of the Business and Professions add Section 1367.48 to the Health and Safety Code, and to add Section 10123.95 to the Insurance Code, relating to healing arts. health care coverage.

Existing law, the Knox-Keene Health Care Service Plan Act of 1975 (Knox-Keene), provides for the licensure and regulation of health care service plans by the Department of Managed Health Care, and makes a willful violation of the act a crime. Existing law provides for the regulation of health insurers by the Department of Insurance. Existing law requires a health care service plan or health insurer that covers outpatient prescription drug benefits to provide coverage for specified prescription drugs and to post its drug formularies on its Internet Web site.
This bill would require a specified health care service plan contract or individual or small group health insurance policy that covers outpatient prescription drug benefits with coverage for naltrexone or acamprosate to provide coverage for those 2 drugs if prescribed by a licensed health care professional. Because a willful violation of the bill’s requirements relative to health care service plans would be a crime, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.

Existing law permits the Medical Board of California, the Dental Board of California, and the California State Board of Pharmacy to reproduce records that they have a duty to keep if those records are destroyed by fire or public calamity.

This bill would make a nonsubstantive change to this provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 1367.48 is added to the Health and Safety Code, to read:

1367.48.
 A health care service plan contract, except a specialized health care service plan contract, that is issued, amended, delivered, or renewed on or after January 1, 2019, that covers outpatient prescription drug benefits with coverage for naltrexone or acamprosate shall provide coverage for a prescription for naltrexone or acamprosate prescribed by a licensed health care professional affiliated with the plan.

SEC. 2.

 Section 10123.95 is added to the Insurance Code, to read:

10123.95.
 An individual or small group health insurance policy that is issued, amended, or renewed on or after January 1, 2019, that covers outpatient prescription drug benefits with coverage for naltrexone or acamprosate shall provide coverage for a prescription for naltrexone or acamprosate prescribed by a licensed health care professional.

SEC. 3.

 No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
SECTION 1.Section 500 of the Business and Professions Code is amended to read:
500.

If the register or book of registration of the Dental Board of California, the Medical Board of California, or the California State Board of Pharmacy is destroyed by fire or other public calamity, the board, whose duty it is to keep the register or book, may reproduce it so that there may be shown as nearly as possible the record existing in the original at the time of destruction.
