An act to add Section 13017 to the Penal Code, relating to crimes.

AB 2644, as introduced, Davies. Crimes: drug cartels.
Existing law establishes the Department of Justice, and establishes that the department is under the direction and control of the Attorney General. Existing law requires the Department of Justice to perform duties in the investigation, detection, apprehension, prosecution, or suppression of crimes as may be assigned by the Attorney General in the performance of their duties.
This bill would make findings and declarations stating that drug cartels, as defined, are foreign terrorist organizations. The bill would require the Attorney General to submit a report to the Legislature with policy recommendations to enhance the ability of the state to prevent criminal activity of drug cartels, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 Section 13017 is added to the Penal Code, to read:

13017.
 (a) The Legislature finds and declares that drug cartels are foreign terrorist organizations.
(b) (1) On or before January 1, 2026, the Attorney General shall submit a report to the Legislature with policy recommendations to enhance the ability of this state to prevent criminal activity of drug cartels.
(2) A report to be submitted pursuant to this subdivision shall be submitted in compliance with Section 9795 of the Government Code.
(c) For the purposes of this section, “drug cartel” means an ongoing formal association of persons in which members or associates individually or collectively engage in human trafficking, drug trafficking for profit, or any act of terrorism as described in Article 4.6 (commencing with Section 11415) of Chapter 3 of Title 1.
