   An act to amend  Section   Sections 7011.4
and  7106.5 of the Business and Professions Code, relating to
professions and vocations.

   AB 2554, as amended, Bill Berryhill. Contractors.
   Existing law, the Contractors' State License Law, provides for the
licensure and regulation of contractors by the Contractors' State
License Board.  The   Under existing law, there
is an enforcement unit within the board with specified
responsibilities. Under existing law, the  registrar of
contractors is the executive officer and secretary of the board and
is required to carry out specified administrative duties. Under
existing law, the expiration, cancellation, forfeiture, suspension,
or voluntary surrender of a license does not deprive the registrar of
jurisdiction to proceed with, among other things, any investigation
or disciplinary proceeding against the license.
   This bill would  rename the enforcement unit as the
enforcement division and would  additionally specify that
revocation of a license does not deprive the board of that
jurisdiction.
   Vote: majority. Appropriation: no. Fiscal committee: no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 7011.4 of the  
Business and Professions Code   is amended to read: 
   7011.4.  (a) Notwithstanding Section 7011, there is in the
Contractors' State License Board, a separate enforcement 
unit   division  which shall rigorously enforce
this chapter prohibiting all forms of unlicensed activity.
   (b) Persons employed as enforcement representatives in this
 unit   division  and designated by the
Director of Consumer Affairs are not peace officers and are not
entitled to safety member retirement benefits. They do not have the
power of arrest. However, they may issue a written notice to appear
in court pursuant to Chapter 5c (commencing with Section 853.5) of
Title 3 of Part 2 of the Penal Code.
   SECTION 1.   SEC. 2.   Section 7106.5 of
the Business and Professions Code is amended to read:
   7106.5.  The expiration, cancellation, forfeiture, revocation, or
suspension of a license by operation of law or by order or decision
of the registrar or a court of law, or the voluntary surrender of a
license by a licensee, shall not deprive the registrar of
jurisdiction to proceed with any investigation of or action or
disciplinary proceeding against the license, or to render a decision
suspending or revoking the license.
