    An act to amend Section 1784 of the Welfare and
Institutions Code, relating to youths.   An act to add
Section 5024.3 to the Penal Code, relating to prisons.

Prisons: medical supplies: demonstration contracts.  
   Existing law authorizes the Secretary of the Department of
Corrections and Rehabilitation to adopt regulations requiring the
manufacturers of drugs to pay the department a rebate for the
purchase of drugs for offenders in state custody that is equal to the
rebate that would be applicable under the federal Social Security
Act. Existing law also allows the department to establish
cost-effective strategies for the procurement of drugs in cooperation
with the Department of General Services.  
   This bill would authorize the department to enter into
demonstration contracts with manufacturers of medical supplies for
the purpose of establishing rebate programs or other cost-saving
mechanisms and achieving demonstrated cost savings in the purchase of
medical supplies. The bill would require the department to maintain
a list of supplies for which contracts have been executed pursuant to
these provisions.  
   Existing law states the findings and declarations of the
Legislature that the mobilizations of community resources to help in
providing youthful offenders with services which relate to the root
causes of delinquency is vital and that juvenile justice community
resource programs should be encouraged and supported.

   This bill would make technical, nonsubstantive changes to those
provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 5024.3 is added to the 
 Penal Code   , to read:  
   5024.3.  (a) The Department of Corrections and Rehabilitation may
enter into demonstration contracts with manufacturers of medical
supplies for the purpose of establishing rebate programs or achieving
other cost-saving mechanisms and demonstrated cost savings in the
purchase of medical supplies. Contracts may be entered into for items
of the department's selection, including, but not limited to,
diabetes test strips, incontinence supplies, and creams and washes.
   (b) The department shall maintain a list of the supplies for which
contracts have been executed pursuant to this section.
   (c) This section does not prevent the department from maintaining
or entering into contracts with small retail businesses to supply
medical supplies for use by the department.  
  SECTION 1.    Section 1784 of the Welfare and
Institutions Code is amended to read:
   1784.  The Legislature finds and declares all of the following:
   (a) That the mobilization of community resources to aid in
providing youthful offenders with necessary educational,
psychological, medical, and other services which relate to root
causes of delinquency is vital.
   (b) That due to increased and heavy caseloads, probation officers
cannot be expected to assume the full burden of providing necessary
services to youthful offenders.
   (c) That addressing the root causes of delinquent behavior in a
cost-effective manner yields tremendous societal benefits in the
prevention of future criminality and the integration of the offender
into productive society.
   (d) That by encouraging community participation, programs such as
the Juvenile Justice Connection Project in Los Angeles County have
achieved great success in providing services to young people at a
substantial savings to the taxpayer.
   (e) That efforts to implement similar projects throughout the
state should be encouraged and supported.
