An act to amend Section 50401 of the Government Code, relating to local government. An act to add and repeal Section 15461 of the Government Code, relating to health facilities, and making an appropriation therefor.

AB 2292, as amended, Nazarian. Local government: parks. California Health Facilities Financing Authority Act.
The California Health Facilities Financing Authority Act (act) authorizes the California Health Facilities Financing Authority (authority) to, among other things, make loans from the continuously appropriated California Health Facilities Financing Authority Fund (fund) to participating health institutions, as defined, for financing or refinancing the acquisition, construction, or remodeling of health facilities. Under the act, the authority is authorized to issue revenue bonds to provide the funds for achieving these purposes.
This bill would, until January, 1, 2026, authorize the authority, consistent with the provisions of the act, to make a loan to a for-profit skilled nursing facility, if at least 70% of its patients at any given time are Medi-Cal beneficiaries, to fund emergency preparedness improvements of the skilled nursing facility’s buildings. Because this bill would expand the purposes for which the continuously appropriated fund may be used, it would make an appropriation. The bill would require the authority to make data available to the Legislature regarding the number of loans granted, projects completed, and other benefits provided to patients pursuant to this temporary authorization.

Under existing law, when land has been granted to a local agency in trust or dedicated for park purposes, the construction of buildings on the land by private persons is consistent with the grant or dedication if the buildings are constructed with permission of the legislative body, meet specified architectural requirements, and are used for specified meetings.

This bill would make a nonsubstantive change to this provision.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) As many as 400,000 Californians are cared for annually in licensed long-term care facilities. This number is predicted to increase substantially, because approximately 1,100 Californians turn 65 years of age every day.
(b) The long-term care profession is primarily for-profit skilled nursing facilities that mostly serve Medi-Cal beneficiaries. California Medi-Cal patients utilize approximately two-thirds of all patient days in skilled nursing facilities.
(c) California long-term care facilities employ more than 147,000 employees with payroll benefits that exceed $6.2 billion annually.
(d) Skilled nursing facilities are a critical component in the long-term care health continuum of care and provide high-quality care to some of California’s most sick and needy patients.
(e) Over the past 10 years, there have been 10 skilled nursing facilities built in California, while over 100 skilled nursing facilities have closed.
(f) Almost all skilled nursing facilities throughout the state were built during the 1960s and 1970s and are in dire need of modernizing to address higher acuity patient needs and emergency preparedness challenges.
(g) To protect the availability of safe skilled nursing facilities throughout the state, the Legislature intends to assist skilled nursing facilities that serve Californians who rely on Medi-Cal obtain cost-effective financing to help fund emergency preparedness building improvements.

SEC. 2.

 Section 15461 is added to the Government Code, to read:

15461.
 (a) A participating health institution, as defined in Section 15432, includes a skilled nursing facility, as defined in Section 1250 of the Health and Safety Code, that meets both of the following conditions:
(1) The skilled nursing facility is operated as a for-profit business, including, but not limited to, a corporation.
(2) At any given time, at least 70 percent of the patients of the skilled nursing facility are Medi-Cal beneficiaries.
(b) Consistent with the requirements of this part, the authority may make a loan to a skilled nursing facility, as described in subdivision (a), to fund only emergency preparedness improvements of the skilled nursing facility’s buildings, including, but not limited to, the purchase or upgrade of generators, seismic retrofitting, life safety systems, or other physical improvements that are shown to improve the safety of a building during an emergency.
(c) The authority shall make available to the Legislature, upon request, all data regarding the number of loans granted, projects completed, and other benefits provided to patients pursuant to this section.
(d) This section shall remain in effect only until January 1, 2026, and as of that date is repealed.

SECTION 1.Section 50401 of the Government Code is amended to read:
50401.

When land has been granted to a local agency in trust or dedicated for park purposes, the construction of buildings on the land by private persons is consistent with the grant or dedication if all of the following conditions exist:

(a)The buildings are constructed with the permission of the legislative body.

(b)The buildings are attractive and of early California architecture or a type of architecture approved by the legislative body.

(c)The buildings are used for public meetings or for meetings of historical and patriotic organizations, such as the Native Sons of the Golden West, the Native Daughters of the Golden West, and the Pioneer Society.
