An act to amend Sections 11300, 11302, and 46146.5 of of, and to add Section 11303 to, the Education Code, relating to school attendance.

AB 2019, as amended, Vince Fong. Early and middle college high schools and programs: College and Career Access Pathways partnerships. programs.
Existing law provides for the establishment of early and middle college high schools. Existing law requires each middle college high school to be structured as a broad-based, comprehensive instructional program focusing on college preparatory and school-to-work curricula, among other things. Under existing law, pupils in early college high schools begin taking college courses as soon as they demonstrate readiness and the college credit earned may be applied toward completing an associate or bachelor’s degree, transfer to a 4-year university, or obtaining a skills certificate.
This bill would expand the definition of early and middle college high schools to include early and middle college programs established within a high school. The bill would require each school district, county office of education, or charter school with a middle college high school or program or an early college high school or program, to, beginning on or before March 1, 2027, and each March 1 thereafter, prepare and submit an annual report to the State Department of Education with specified information. The bill would require the department, on or before May 1, 2027, and each May 1 thereafter, to aggregate that reported information and submit a report of the information to the Legislature and the Department of Finance.
Existing law authorizes the governing board of a community college district to enter into a College and Career Access Pathways (CCAP) partnership with the governing board of a school district or a county office of education, or the governing body of a charter school, as provided. Existing law provides that the minimum schoolday in any high school is 240 minutes, except as provided, including that a day of attendance for a pupil enrolled in grades 11 and 12 at an early college high school or middle college high school is 180 minutes of attendance if the pupil is also enrolled in a community college, classes of the California State University, or classes of the University of California, as specified.
This bill would additionally exempt a pupil enrolled in an early college program or a middle college program from the 240-minute minimum schoolday if the pupil is also enrolled in a community college, classes of the California State University, or classes of the University of California, as specified. The bill also would additionally exempt a pupil enrolled under a CCAP partnership from the 240-minute minimum schoolday if the pupil is also enrolled in a community college, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 Section 11300 of the Education Code is amended to read:

11300.
 (a) The Legislature finds and declares that middle college high schools have proven to be a highly effective collaborative effort between local school districts and community colleges. The goal of the middle college high school or program is to select at-promise high school pupils who are performing below their academic potential and place them in an alternative high school located on a community college campus or colocated on an existing high school campus in order to reduce the likelihood that they will drop out of school before graduation.
(b) Each middle college high school or program shall be structured as a broad-based, comprehensive instructional program focusing on college preparatory and school-to-work curricula, career education, work experience, community service, and support and motivational activities.
(c) The specific design of a middle college high school or program may vary depending on the circumstances of the community college or school district, and may include programs established within a high school. The basic elements of the middle college high school or program shall include, but not be limited to, the following:
(1) A curriculum that focuses on college and career preparation.
(2) A reduced adult-student ratio.
(3) Flexible scheduling to allow for work internships, community service experience, and interaction with community college student role models.
(4) Opportunities for experiential internships, work apprenticeships, and community service.

SEC. 2.

 Section 11302 of the Education Code is amended to read:

11302.
 The Legislature finds and declares that early college high schools are innovative partnerships between charter or noncharter public secondary schools and a local community college, the California State University, or the University of California that allow pupils to earn a high school diploma and up to two years of college credit in four years or less. Early college high schools or programs are small schools or programs established within a high school that blend high school and college into a coherent educational program. In early college high schools or programs, pupils begin taking college courses as soon as they demonstrate readiness and the college credit earned may be applied toward completing an associate or bachelor’s degree, transfer to a four-year university, or obtaining a skills certificate.

SEC. 3.

 Section 11303 is added to the Education Code, to read:

11303.
 (a) Each school district, county office of education, or charter school with a middle college high school or program or an early college high school or program, shall, beginning on or before March 1, 2027, and each March 1 thereafter, prepare and submit an annual report to the department. The report shall include all of the following information regarding the middle college high school or program or the early college high school or program:
(1) The total number of high school pupils, disaggregated by gender and ethnicity and reported in compliance with all applicable state and federal privacy laws.
(2) The total number of college-level courses, by course category and type.
(3) The total number and percentage of successful course completions, by course category and type.
(4) Course and program outcomes for pupils, disaggregated by grade level, gender, socioeconomic status, race and ethnicity, and other disproportionately impacted groups.
(b) On or before May 1, 2027, and each May 1 thereafter, the department shall aggregate the information reported pursuant to subdivision (a) and submit a report of the information to the Legislature, in compliance with Section 9795 of the Government Code, and to the Department of Finance.

SEC. 3.SEC. 4.

 Section 46146.5 of the Education Code is amended to read:

46146.5.
 (a) A day of attendance for a pupil enrolled in grade 11 or 12 at an early college high school or program or a middle college high school or program is 180 minutes of attendance if the pupil is also enrolled part time in courses of the California State University or the University of California for which academic credit will be provided upon satisfactory completion of enrolled courses.
(b) A day of attendance for a pupil enrolled in an early college high school or program, program or a middle college high school or program, or enrolled under a College and Career Access Pathways partnership agreement, who is also a special part-time student enrolled in a community college under Article 1 (commencing with Section 48800) of Chapter 5 of Part 27, and who will receive academic credit upon satisfactory completion of enrolled courses, is 180 minutes of attendance.
(c) A day of attendance for a pupil enrolled in an early college high school or program, program or a middle college high school or program, or enrolled under a College and Career Access Pathways partnership agreement who does not satisfy subdivision (a) or (b) is 240 minutes of attendance.
(d) For a charter school that is an early college high school or middle college high school, for purposes of calculating classroom-based average daily attendance for classroom-based instruction apportionments, at least 80 percent of the instructional time offered by the charter school shall be at the schoolsite, and the charter school shall require the attendance of a pupil enrolled in grade 11 or 12 for a minimum of 50 percent of the minimum instructional time required to be offered pursuant to paragraph (1) of subdivision (a) of Section 47612.5 if the pupil is also enrolled part time in courses of the California State University or the University of California for which academic credit will be provided upon satisfactory completion of enrolled courses.
(e) For a charter school that is an early college high school or middle college high school, for purposes of calculating classroom-based average daily attendance for classroom-based instruction apportionments, at least 80 percent of the instructional time offered by the charter school shall be at the schoolsite, and the charter school shall require the attendance of a pupil for a minimum of 50 percent of the minimum instructional time required to be offered pursuant to paragraph (1) of subdivision (a) of Section 47612.5 if the pupil is also a special part-time student enrolled in a community college under Article 1 (commencing with Section 48800) of Chapter 5 of Part 27, and who will receive academic credit upon satisfactory completion of enrolled courses.
(f) For a pupil enrolled in a charter school that is an early college high school or middle college high school and who does not satisfy the attendance and enrollment requirements of subdivision (d) or (e), for purposes of calculating classroom-based average daily attendance for classroom-based instruction apportionments, at least 80 percent of the instructional time offered by the charter school shall be at the schoolsite, and the charter school shall require the attendance of the pupil for a minimum of 67 percent of the minimum instructional time required to be offered pursuant to paragraph (1) of subdivision (a) of Section 47612.5.
(g) For purposes of this section, the following definitions apply:

(1)“College and Career Access Pathways partnership agreement” means the same as described in Section 76004.

(2)“Middle “middle college high school or program program means the same as described in Section 11300 and early “early college high school or program program means the same as described in Section 11302.
(h) The requirements of this section shall be subject to annual audits, which shall be conducted pursuant to Section 41020.
