The people of the State of California do enact as follows:
SECTION 1.
Section 42238.023 is added to the Education Code, immediately following Section 42238.022, to read:42238.023.
(a) Notwithstanding any other law, and for purposes of calculating local control funding formula entitlements pursuant to Sections 2574, 2576, 42238.02, and 42238.03, as applicable, if the Superintendent determines that a local educational agency’s attendance yield in the 2019–20 fiscal year is greater than the attendance yield in the 2021–22 fiscal year, the Superintendent shall adjust the local educational agency’s 2021–22 average daily attendance pursuant to subdivision (b). This determination shall be made by the following calculation for each local educational agency:(a)Notwithstanding Section 41601, Sections 42238.05 to 42238.053, inclusive, Section 46010, or any other law, for purposes of calculating apportionments for the 2022–23 fiscal year for a local educational agency, the department shall use the greater of (1) the average daily attendance in the 2019–20 fiscal year reported for both the second period and the annual period apportionment that included all full school months from July 1, 2019, to February 29, 2020, inclusive, and extended year average daily attendance attributed to the 2019–20 school year reported pursuant to Section 96 of Chapter 24 of the Statutes of 2020, (2) the average daily attendance attributed to the 2020–21 fiscal year pursuant to Section 42238.05, (3) the average daily attendance attributed to the 2021–22 fiscal year pursuant to
Section 42238.05, or (4) the average daily attendance attributed to the 2022–23 fiscal year pursuant to Section 42238.05 for the local educational agency.
(b)For purposes of this section, ”local educational agency” means a school district, county office of education, or charter school.
This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the California Constitution and shall go into immediate effect. The facts constituting the necessity are:
In order to mitigate the impacts of declining enrollment due to both long-term demographic trends and the COVID-19 pandemic, it is necessary that this act take effect immediately.
