   An act to amend Sections 7560, 7562, and 7563 of the Government
Code, relating to state government.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1557, as amended, Committee on Jobs, Economic Development, and
the Economy. Federal funding: economic stimulus bill.
   (1) Existing law requires any state agency that applies for
federal funds to meet a mandatory responsibility under federal or
state law, and that application is not approved, to submit, among
other things, an identification of the federal program for which the
application was denied, and the name of the federal administering
agency, and an indication of the reason or reasons the application
was not approved, to the Department of Finance, the Office of
Planning and Research, and the Joint Legislative Budget Committee,
within 15 calendar days  or   of  its
receipt of notification of lack of approval of the application.
   This bill would require any state agency that applies for federal
funds pursuant to the federal economic stimulus acts of 2008 and
2009, and receives approval, to submit, among other things, an
identification of the federal program for which the application was
approved, and an identification of the federal administering agency
 and department  , an identification of the amount of funds
being made available and  an estimate of the amount of total
funds from other federal, state, and local programs and services
affected by the approval of the state agency's application 
 a timeline for receiving the funds  , to the Department of
Finance, the Office of Planning and Research, and the Joint
Legislative Budget Committee, within 15 calendar day of its receipt
of notification of approval.
   (2) Existing law  require   requires 
the Joint Legislative Budget Committee to submit a summary of the
information reported by the state agency, within 10 calendar days of
receipt of notification of a lack of approval of an application for
federal funds, to each member of the appropriate legislative policy
committees and to each member of the legislative fiscal committees.
   This bill would also require the Joint Legislative Budget
Committee to submit that summary when informed of an approval of an
application for federal funds.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 7560 of the Government Code is amended to read:

   7560.  The Legislature hereby declares both of the following:
   (a) It is the intent of the Legislature to assure receipt of
federal funding by the State of California. It is also the intent of
the Legislature to assure that if lack of interagency agreement or
lack of coordination between state agencies jeopardizes state receipt
of federal funds, including, but not limited to, funds available for
services to handicapped children, an expeditious process shall exist
for resolving such interagency matters.
   (b) It is the intent of the Legislature that state government
serve as a facilitator in assisting local communities, workers and
other individuals, and businesses in accessing federal funds
appropriated in conjunction with the federal economic stimulus
programs approved by the Congress in 2008 and 2009.
  SEC. 2.  Section 7562 of the Government Code is amended to read:
   7562.  (a) If any state agency applies for federal funds to meet a
responsibility under federal or state law and such application is
not approved, the state agency shall submit to the Department of
Finance, the Office of Planning and Research, and the Joint
Legislative Budget Committee, within 15 calendar days of its receipt
of notification of the lack of approval of its application, all of
the following:
   (1) An identification of the federal program for which the
application was not approved and an identification of the federal
agency  and department  administering the funds.
   (2) An estimate of the amount of funds affected by the lack of
approval of the state agency application.
   (3) An indication of the reason or reasons the application was not
approved.
   (4) A description of any issues pertaining to responsibilities or
actions of other state or local agencies which have affected the lack
of approval.
   (b) If any state agency applies for federal funds pursuant to the
federal economic stimulus acts of 2008 and 2009, and receives
approval, the state agency shall submit to the Department of Finance,
the Office of Planning and Research, and the Joint Legislative
Budget Committee, within 15 calendar days of its receipt of
notification of approval of its application, all of the following:
   (1) An identification of the federal program for which the
application was approved and an identification of the federal agency
 and department  administering the funds.
   (2) An identification of the amount of funds being made available
 and an estimate of the amount of total funds from other
federal, state, and local programs and services affected by the
approval of the state agency's application.   and a
timeline for recei   ving the funds. 
   (3) A list of other federal, state, and local programs and
services  potentially  affected by the approval of the state
agency application. 
   (4) A description of any issues pertaining to responsibilities or
actions of other state or local agencies that have affected the
approval.  
   (4) A description of any issues pertaining to implementation of
the program or use of the federal funding. 
  SEC. 3.  Section 7563 of the Government Code is amended to read:
   7563.  The Joint Legislative Budget Committee shall submit to each
member of the appropriate legislative policy committees and to each
member of the legislative fiscal committees, within 10 calendar days
of receipt of notification of either an approval or the lack of an
approval of an application for federal funds reported to it pursuant
to Section 7562, a summary of the information specified in
subdivisions (a) through (d) of Section 7564.
