An act to amend Section 43332 of, and to repeal Chapter 4 (commencing with Section 43571) of Division 17 of, the Food and Agricultural Code, relating to agriculture.

Fruit, nut, and vegetable standards: out-of-state processing.
(1) Existing law authorizes the Secretary of Food and Agriculture to adopt regulations regarding fruit, nut, and vegetable standards. Existing law exempts from these standards fruits, nuts, and vegetables that are being transported or delivered under specified conditions, including from the orchard or field where they were produced to a packing plant within the state for first processing, grading, or packing.
This bill would expand the above exemption to all packing plants, regardless of the state in which the packing plant operates.
(2) Existing law exempts from the fruit, nut, and vegetable standards the shipment, transportation, or movement of melons and vegetables in field bins or bulk out of the state, up to 25 miles beyond the border, under specified
conditions.
This bill would repeal the above provision.

The people of the State of California do enact as follows:
SECTION 1.
Section 43332 of the Food and Agricultural Code is amended to read:43332.
It is unlawful for any person who has been issued a valid permit pursuant to regulations established by the(a) A common carrier which that operates over a regular route or between fixed termini and transports any such
of the fruits, nuts, or vegetables in good faith and in accordance with its duties as a common carrier.
(b) A person that is transporting fruits, nuts, or vegetables from the orchard or field where they were produced to a packing plant within the state for first processing, grading, or packing.
(c) A person that is transporting fruits, nuts, or vegetables in accordance with the terms of a disposal order which that is duly issued pursuant to Section 42881.
