A CONCURRENT RESOLUTION

 

proposing an amendment to the constitution of arizona; amending the constitution of arizona by adding article VI.II; relating to the regulation of the legal profession.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1.  Article VI.II, Constitution of Arizona, is proposed to be added as follows if approved by the voters and on proclamation of the Governor:

ARTICLE VI.II.  REGULATION OF THE LEGAL PROFESSION

1.  Regulation of the legal profession

Section 1.  A.  Lawyers shall be protected. Due Process is required. After the disciplinary decision, if the lawyer makes such a request, the People shall make the final decision by means of a verdict of an impartial Jury.

B.  Lawyers shall be accountable for violations of all Ethical Rules, including those produced by the Legislature.

1.  Due Process is required, including but not limited to transparency and rules of evidence.

2.  The People shall make the final decision by means of a verdict from an impartial Jury, if the person who made the complaint makes such a request.

C.  Fees charged for a hearing decided by a Jury shall not exceed $500.

D.  Lawyers shall be responsible for defending the Rights of their clients as prescribed in the Constitution and Law.  Any oath or allegiance contrary to this is prohibited.

E.  Lawyers have the Right to be confronted by accusers and evidence which is not false or perjury, nor exculpatory evidence withheld, violations of which are criminal and shall be prosecuted at the exclusive direction of a grand jury.

F.  No regulatory body has authority until the lawyer has been advised of these Rights.

G.  This Section merely sets minimum standards which may not have previously existed.  This Section does not diminish other Rights found in this sacred document which is the Supreme Law of the Land.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
