AN ACT

 

amending title 16, chapter 4, article 4, Arizona Revised Statutes, by adding section 16-442.02; relating to the conduct of elections.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 16, chapter 4, article 4, Arizona Revised Statutes, is amended by adding section 16-442.02, to read:

START_STATUTE16-442.02. Ballot tabulating equipment; fractional votes; operating manual; posting

A. Ballot tabulating equipment that is capable of registering fractional votes or that is SUSCEPTIBLE to manipulation by an algorithm that would allow the equipment to register fractional votes may not be used for an election in this state.

B. The county recorder or other officer in charge of elections shall post CONSPICUOUSLY on the county's website the following:

1. the operating manual for any tabulating equipment used by the county, which shall describe all of the capabilities of the TABULATING equipment.

2. Within twenty-four HOURS after occurring, any updates to the tabulating equipment software or hardware.

C. If the posted manual for the tabulating equipment does not accurately describe all of the capabilities of the equipment, the county may not enter into a contract with the tabulating equipment provider, or if a contract has already been executed, the contract with the tabulating equipment provider is canceled.
