AN ACT

 

amending title 41, chapter 23, article 1, Arizona Revised Statutes, by adding section 41‑2505; relating to the state procurement code.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 23, article 1, Arizona Revised Statutes, is amended by adding section 41-2505, to read:

START_STATUTE41-2505.  Preference for Arizona bidders for identical bids; definition

A.  For contracts awarded pursuant to section 41-2533, subsection G, if there are two or more low, responsive offers from responsible bidders, an Arizona bidder shall be given a preference over a nonresident bidder by increasing the bid of a nonresident bidder by five per cent.

B.  The penalty for not performing at least fifty per cent of the labor associated with the bid using Arizona workers who file a tax return in this state shall be a reduction in the contract price equal to the percentage of the labor required to meet the fifty per cent threshold for in-state labor.

C.  For the purposes of this section, "Arizona bidder" means a bidder who satisfies all of the following:

1.  Is authorized to transact business in this state.

2.  Maintains a physical presence in this state.

3.  Has paid all assessed taxes.

4.  Performs at least fifty per cent of the labor associated with the bid using Arizona workers who file a tax return in this state. END_STATUTE
