An Act

 

providing for a rulemaking exemption for the department of water resources.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Department of water resources; fees; active management area; irrigation non-expansion area; exemption; delayed repeal

A. Notwithstanding any other law, the department of water resources is exempt from the rulemaking requirements prescribed in title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act for the purpose of reducing fees for the following:

1. An application for a certificate of grandfathered right in an active management area that is established after January 1, 2022.

2. An application for a notice of authority to irrigate land in an irrigation non-expansion area that is established after January 1, 2022.

B. This section is repealed from and after December 31, 2024.

Sec. 2. Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
