AN ACT

 

prescribing a Study to reduce statutory educational barriers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Study to reduce statutory educational barriers; report

A.  On or before September 15, 2012, the state board of education shall select and enter into an agreement with a public or private entity to conduct a study to reduce statutory educational barriers and to enable the adoption of e-learning to enhance student academic performance.

B.  The entity selected by the state board of education shall:

1.  Review each statute in each title of the Arizona Revised Statutes to determine whether the statute applies or relates to public education.

2.  Develop a taxonomy of classification that will address each statute that applies or relates to public education.

3.  Produce a comprehensive index of all the statutes that apply or relate to public education, including a short description of each statute.

4.  Analyze each indexed statute to determine if the statute:

(a)  Presents barriers to the effective, efficient and flexible management by school district governing boards, charter school governing bodies, school officials, school administrators and school employees.

(b)  Presents barriers to the effective, efficient and flexible management of school systems and financial practices.

(c)  Should be amended or repealed to facilitate the effective, efficient and accessible adoption of e-learning‑based education innovation.  For the purposes of this subdivision, "e-learning‑based education innovation" includes increasing the depth, breadth and pace of individualized student learning using e-learning technology and pedagogy.

5.  Develop recommendations for the enactment of new statutes that are required to facilitate the effective, efficient and accessible implementation of e-learning systems, infrastructure, curricula and pedagogy by teachers and other educators in the pursuit of individualized, student‑paced e‑learning‑supported education for all students.

6.  Submit a report on or before June 30, 2013 to the president of the senate, the speaker of the house of representatives and the governor that includes specific recommendations to:

(a)  Amend or repeal specified statutes that have been determined to be barriers or potential barriers to the effective, efficient and accessible implementation of e-learning systems, infrastructure, curricula and pedagogy by teachers and other educators in the pursuit of individualized, student‑paced e-learning‑supported education for all students.

(b)  Enact new statutes that that are required to facilitate the effective, efficient and accessible implementation of e-learning systems, infrastructure, curricula and pedagogy by teachers and other educators in the pursuit of individualized, student‑paced e-learning‑supported education for all students.

C.  The entity selected by the state board of education shall submit a copy of the report prescribed in this section to the secretary of state.

D.  If sufficient monies are appropriated or available for this purpose, the state board of education may distribute up to four million dollars to the entity selected to conduct the study to reduce statutory educational barriers in order to carry out the purposes of this section.
