AN ACT
Prioritizing the repairs of state highways through tribal lands.

Be it enacted by the Legislature of the State of Arizona:
Section 1. State transportation board; prioritization of highways through tribal lands
Notwithstanding section 28‑6993, Arizona Revised Statutes, or any agreement entered into by the department of transportation for the distribution and expenditure of monies from the state highway fund established by section 28‑6991, Arizona Revised Statutes, or from the statewide transportation acceleration needs account established by section 28‑7009, Arizona Revised Statutes, in fiscal years 2009‑2010 and 2010‑2011 the state transportation board shall prioritize repairs and maintenance of any state highway that extends into or through tribal lands above any other projects included in the long‑range statewide transportation plan prescribed by section 28‑506, Arizona Revised Statutes, or the statewide acceleration needs identified pursuant to sections 28‑7009, 28‑7010 and 28‑7011, Arizona Revised Statutes.
Sec. 2. Emergency
This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
