AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2923.01; making an appropriation; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2923.01, to read:

START_STATUTE36-2923.01.  Hemophilia and related blood disorders; private insurance assistance; grants; program termination

A.  Beginning October 1, 2012, the administration shall establish a program to assist members who have hemophilia and related bleeding disorders to obtain comprehensive services through private insurers for the treatment of these disorders.  The administration shall:

1.  Identify qualified members.

2.  Prescribe the application process.

3.  Issue an annual grant to a statewide hemophilia organization that must use grant monies to administer the program.

B.  The grant recipient organization must:

1.  Assist individuals to obtain and pay for private insurance for the treatment of hemophilia and related bleeding disorders.  The private insurance coverage must offer more services to hemophiliacs than are required to be provided by program contractors pursuant to this chapter.

2.  Establish a separate account for all grant monies it receives from the administration.

3.  On or before October 1 of each year, submit a report to the director regarding the organization's use of grant monies.

C.  A member who is receiving services through a private insurer pursuant to this section may continue to be enrolled as a member pursuant to this chapter to receive services that are not related to hemophilia and related bleeding disorders.

D.  Subject to the availability of monies, the grant recipient organization may also use grant monies to assist the following to purchase health insurance policies or continue paying the premiums of current health insurance policies relating to the coverage of persons with hemophilia and related bleeding disorders:

1.  Persons who have an annual family income that does not exceed two hundred fifty per cent of the federal poverty guidelines.

2.  Persons who have an annual income of more than two hundred fifty per cent of the federal poverty guidelines and who have experienced a significant event that establishes a need for assistance, such as a catastrophic incident or the loss of employment.

E.  An organization that provides insurance premium assistance services pursuant to subsection D of this section must:

1.  Advertise the availability of these services by providing information regarding the assistance to hematologists, hemophilia treatment centers, association publications, hemophilia-related websites and social media.

2.  Allow applicants to complete and submit an application as prescribed by the organization on the organization's website.

3.  Complete the application process within thirty days.

4.  Issue checks for insurance premiums only to the insurer.

F.  The program established by this section ends on October 1, 2022 pursuant to section 41-3102. END_STATUTE

Sec. 2.  Appropriation; hemophilia organization grant for insurance assistance; exemption

A.  The sum of $___________ is appropriated from the state general fund in fiscal year 2012-2013 to the Arizona health care cost containment administration for the issuance of grants pursuant to section 36-2923.01, Arizona Revised Statutes, as added by this act.

B.  The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
