SENATE BILL 1306

 

 

 

AN ACT

 

amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9‑499.16; relating to the regulation of alarm businesses.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-499.16, to read:

START_STATUTE9-499.16.  Alarm system installation; licensed contractors; state preemption; definitions

A.  the licensing of Alarm BUSINESSES and Alarm Agents is a MATTER OF STATEWIDE CONCERN.  Obtaining information and licensing of Alarm Businesses, or Alarm Agents is not subject to further regulation by cities, including charter cities, towns and counties or other political subdivision of this state.

B.  Cities, charter cities, towns and counties may not require any additional licensing of Alarm Businesses or Alarm Agents licensed according to statute prior to the effective date of this section.

C.  No city, charter city, town or county may request or obtain personal customer information from any Alarm Business as a condition of doing business in the city, charter city, town or county without a proper court order.

D.  A city, charter city, town or county declared to be in violation of this section, the state treasurer shall withhold from the distribution of state shared revenues to the affected city or town five per cent of the amount of the state shared revenues for each violation until the city, charter city, town or county corrects the violation.  Each day shall constitute a separate violation.

E.  for the purposes of this section:

1.  "Alarm Agent" Means any person, whether an employee, independent contractor or otherwise, who acts on behalf of an alarm business and leases, rents, maintains, services, repairs or installs alarm systems, other than alarm systems located on the person's own property of the person's employer.

2.  "Alarm Business" Means any person that, either individually or through a third party, engages in the business of providing alarm monitoring services or the business of selling, leasing, renting, maintaining, repairing or installing alarm systems, devices or services. END_STATUTE
