AN ACT

 

amending Title 15, chapter 9, article 1, Arizona Revised Statutes, by adding section 15-902; repealing sections 15‑961, 15‑962 and 15‑962.01, Arizona Revised Statutes; relating to school finance.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 9, article 1, Arizona Revised Statutes, is amended by adding section 15-902, to read:

START_STATUTE15-902.  Determination of student count

Notwithstanding any other law, beginning in the 2013‑2014 school year, the student count shall be determined initially using an estimated student count based on actual registration of pupils before the beginning of the school year.  After the first one hundred days or two hundred days in session, as applicable, the school district shall revise the student count to equal the actual average daily membership, as defined in section 15‑901, of the school district.  Before the one hundredth day or two hundredth day in session, as applicable, the department of education may require a school district to report periodically regarding pupil enrollment and attendance, and the department of education may revise its computation of state aid and equalization assistance based on the report.  A school district shall revise its student count and base support level before May 15.  A school district that overestimated its student count shall revise its budget before May 15.  A school district that underestimated its student count may revise its budget before May 15.  END_STATUTE

Sec. 2.  Repeal

Sections 15-961, 15-962 and 15-962.01, Arizona Revised Statutes, are repealed.

Sec. 3.  Base level and additional assistance; adjustments

A.  In addition to any other changes in the base level established in section 15‑901, subsection B, paragraph 2, Arizona Revised Statutes, that may be required in fiscal year 2013‑2014, the base level shall be increased by two hundred four dollars sixty‑eight cents.

B.  In addition to any other changes in the charter school additional assistance amounts per student count established in section 15‑185, subsection B, paragraph 4, Arizona Revised Statutes, that may be required in fiscal year 2013‑2014, the amount per student count in kindergarten programs and grades one through eight shall be reduced by two hundred twenty-six dollars sixty‑six cents and the amount per student count in grades nine through twelve shall be reduced by two hundred sixty‑four dollars fourteen cents in order to offset increases in base support level funding that charter schools will receive under subsection A of this section.

Sec. 4.  Conforming legislation

The legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the fifty‑first legislature, second regular session.
