AN ACT

 

amending section 14‑5302, Arizona Revised Statutes; relating to guardians of incapacitated persons.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 14-5302, Arizona Revised Statutes, is amended to read:

START_STATUTE14-5302.  Venue

A.  The venue for guardianship proceedings for an incapacitated person is in the county where the incapacitated person resides or is present.  Except as provided in subsection B of this section, if the incapacitated person is admitted to an institution pursuant to order of a court of competent jurisdiction, venue is also in the county in which that court sits.

B.  If a guardianship proceeding is brought in a county other than the one in which the incapacitated person resides and a member of the incapacitated person's family files a motion to transfer the proceeding to the county in which the incapacitated person resides, the court in which the action is brought shall order the action transferred to the county in which the incapacitated person resides.  Admission to an institution in a county pursuant to a court order does not constitute residence in that county by that fact alone.
