AN ACT
amending Title 38, chapter 4, article 1, Arizona Revised Statutes, by adding section 38-620; relating to reward incentives for state employees.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 38, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 38-620, to read:
38-620. Incentive rewards for state employees; applicability; definitions
A. The director of the department of administration may adopt rules to provide incentive rewards to state employees for backfilling vacant positions.
B. Notwithstanding section 35‑174, subsection B, the head of each governmental unit may use vacancy savings to provide incentive rewards for employees who backfill vacant positions in an amount of not more than one‑third of the vacancy savings realized from that vacant position for not more than five years. Notwithstanding any other law, two‑thirds of the amount of the vacancy savings reverts to the fund from which it was appropriated. The head of the governmental unit shall report all vacancy savings to the department of administration within thirty days after the vacancy.
C. The head of the governmental unit may post a position open for backfilling for sixty days after the position becomes vacant. One or more employees may apply to the head of the governmental unit to backfill the vacant position as a team or as an individual. If approved by the head of the governmental unit, the applicable employees are entitled to receive a proportionate amount of the one‑third vacancy savings.
D. Every six months, the head of the governmental unit shall review the employee's performance and determine whether the employee is satisfactorily performing the duties of the employee's permanent position and the backfilled position. If the employee meets or exceeds the performance measures, the employee is entitled to continue to receive the incentive reward. If the employee did not meet the performance measures, the employee is not entitled to receive the incentive reward, and monies that were available for the incentive reward revert to the appropriate state fund.
E. For the purposes of this section:
1. "Backfill" means to fill a vacant position with an employee of the same governmental unit.
2. "Governmental unit" means an agency, department, board or commission of this state.
3. "Vacancy saving" means any monies saved or generated in personal services and employee-related expenditures by:
(a) Not filling a position that has become vacant by termination of an employee after the effective date of this section.
(b) Not filling a position authorized after the effective date of this section.
