AN ACT
amending title 35, chapter 1, article 2, Arizona Revised Statutes, by adding section 35‑125; relating to state revenue expenditures.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 35, chapter 1, article 2, Arizona Revised Statutes, is amended by adding section 35-125, to read:
35-125. Authorized annual state revenues expenditure amount; calculation and report; requirements for exceeding limit; definition of state revenues
A. Beginning with fiscal year 2011-2012, the legislature may appropriate an amount of state revenues up to the sum of the following:
1. The amount of state revenue appropriations under the limitations of this paragraph in the preceding fiscal year, adjusted by the sum of the following percentages:
(a) The positive or negative percentage change for the most recent available twelve month period in the population of this state. For the purposes of this paragraph, the joint legislative budget committee shall determine the population of this state by using only the most recent data from the United States decennial census or only the average of the annual revisions of population data by the department of economic security, or its successor agency, and demographic publications of state universities.
(b) The positive or negative percentage change for the most recent available twelve month period in the cost of living. For the purposes of this paragraph, the joint legislative budget committee shall determine the cost of living by using only the GDP price deflator, as defined by section 41-563, or the gross state product for Arizona, whichever index is greater, or a successor index, as reported by the responsible agency of the United States government. The joint legislative budget committee may take into account minor technical adjustments to the index that are made occasionally by the United States government.
2. Any amount appropriated for debt service on obligations of this state or of any department, office, agency, commission, board or other instrumentality of this state outstanding on June 30, 2010.
3. Any amount appropriated to restore payments deferred from fiscal year 2009‑2010 into the current fiscal year.
B. On or before November 1 of each year, the joint legislative budget committee shall determine and publish a preliminary estimate of the total state revenues for the following fiscal year.
C. On or before January 1 of each year, the joint legislative budget committee shall:
1. Determine and publish a final estimate of the total state revenues for the following fiscal year.
2. Determine and publish the amount of state revenues that may be appropriated for the following fiscal year pursuant to subsection A of this section.
D. If the legislature enacts a budget for a fiscal year that exceeds the amount reported by the joint legislative budget committee under subsection C of this section, the legislature must simultaneously enact a separate concurrent resolution that acknowledges the limit under subsection C of this section and expresses the intent to authorize the expenditure of state revenues in excess of that amount.
E. For the purposes of this section, "state revenues" has the same meaning prescribed in article IX, section 17, Constitution of Arizona.
