An Act
appropriating monies for secure behavioral health residential facilities.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Appropriations; Arizona health care cost containment system administration; secure behavioral health residential facilities; request for proposals; report; provider rate increase; exemption
A. The sum of $25,000,000 is appropriated from the state general fund in fiscal year 2024-2025 to the Arizona health care cost containment system administration for the support and construction of secure behavioral health residential facilities to be licensed pursuant to section 36-425.06, Arizona Revised Statutes. These secure behavioral health residential facilities shall provide secure on-site supportive treatment to persons who are determined to be seriously mentally ill, who are chronically resistant to treatment and who are placed in the facility by a court order issued pursuant to section 36-550.09, Arizona Revised Statutes. Three facilities shall be located in the central geographic service area, one facility shall be located in the north geographic service area and one facility shall be located in the south geographic service area. The Arizona health care cost containment system administration shall allocate up to $5,000,000 for each recipient facility, prioritizing facilities that can open within twelve months after the effective date of this act. If the Arizona health care cost containment system administration does not issue a request for proposals by December 31, 2024, the administration shall report to the president of the senate and the speaker of the house of representatives the reasons why the request for proposals has not been issued and the administration's plans for issuing the request for proposals.
B. The sums of $10,000,000 from the state general fund and $18,768,700 from medicaid expenditure authority are appropriated in fiscal year 2024-2025 to the Arizona health care cost containment system administration for an ongoing secure behavioral health provider rate increase.
C. The appropriations made in subsections A and B of this section are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
