AN ACT
Amending title 32, chapter 32, article 1, Arizona Revised Statutes, by adding section 32-3216; relating to health professionals.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 32, chapter 32, article 1, Arizona Revised Statutes, is amended by adding section 32-3216, to read:
32-3216. Claims regarding specialties; unprofessional conduct; definitions
A. It is an act of unprofessional conduct for a health professional to:
1. Claim that the health professional is board certified as a specialist if this is not true or if the status is not current.
2. Direct the health professional's staff, employer or representative to make a claim that the health professional is board certified as a specialist if this is not true or if the status is not current.
3. Know and approve of the claims of the health professional's staff, employer or representative that the health professional is board certified as a specialist if this is not true or if the status is not current.
4. Claim board certification in any form of advertisement without supplying the full name of the specific agency, organization or entity that granted the certification.
B. For the purposes of this section:
1. "Advertisement" includes billboards, brochures, business cards, pamphlets, radio and television scripts, electronic media, printed telephone directories, telephone and direct mail solicitations and any other means of promotion intended to directly or indirectly induce any person to enter into an agreement for services with the health professional. Advertisement does not include materials that provide information about network providers and that are created by an entity regulated under title 20.
2. "Board certification" means the granting of specialty status by either:
(a) The public regulatory body or agency that licenses the health professional, if authorized by law to confer specialty status.
(b) A private organization or entity that establishes standards of education, training and experience for specialty status recognized by either a national association of the particular health profession or the public regulatory body or agency that licenses the health professional.
