SENATE BILL 1042

 

 

 

AN ACT

 

amending title 9, chapter 4, article 6.4, Arizona Revised Statutes, by adding section 9-469; relating to cities and towns.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 6.4, Arizona Revised Statutes, is amended by adding section 9-469, to read:

START_STATUTE9-469.  City or town permit or plan fee or charge; amount to cover cost of service; notice; hearing

A.  Any single family residential building permit or plan fee or charge that is assessed by a city or town for a building permit or plan must be attributable to and defray or cover the expense of the service for which the fee or charge is assessed.  A fee or charge shall not exceed the actual cost of issuing a permit or plan.

B.  For the purposes of this subsection, "actual cost" means the average cost of a building inspection service or a plan review service, or both, incurred by a city or town for a detached single family residential building.  Before adoption of a new or increased building permit or plan fee or charge or an additional or separate charge, a city or town shall hold a public hearing on the issue pursuant to all applicable public meeting requirements.

C.  A city or town that has an internet website shall publish on its website the method by which the city or town arrived at an assessed permit or plan fee or charge and shall make this document available to the public.

D.  The average cost of a building inspection service or a plan review service must itemize the average cost for each staff position involved in providing the service plus the details of any associated overhead or ancillary costs.  A city or town shall provide these costs on request of the permittee.
