AN ACT
amending section 36‑2801.01, Arizona Revised Statutes; relating to the arizona medical marijuana act.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, section 36-2801.01, Arizona Revised Statutes, is amended to read:
36-2801.01. Addition of debilitating medical conditions
The public may petition the department to add debilitating medical conditions or treatments to the list of debilitating medical conditions set forth prescribed in section 36-2801, paragraph 3. The department shall consider petitions in the manner required by department rule, including public notice and hearing. The department shall approve or deny a petition within one‑hundred-eighty one hundred eighty days of its submission. The approval or denial of a petition is a final decision of the department subject to judicial review pursuant to title 12, chapter 7, article 6. Jurisdiction and venue are vested in the superior court.
Sec. 2. Requirements for enactment; three-fourths vote
Pursuant to article IV, part 1, section 1, Constitution of Arizona, section 36‑2801.01, Arizona Revised Statutes, as amended by this act, is effective only on the affirmative vote of at least three-fourths of the members of each house of the legislature.
