AN ACT

 

Amending title 15, chapter 11, article 1, Arizona Revised Statutes, by adding section 15-1306; relating to the Arizona state schools for the deaf and the blind.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Heading change

The chapter heading of title 15, chapter 11, Arizona Revised Statutes, is changed from "ARIZONA STATE SCHOOL FOR THE DEAF AND THE BLIND" to "ARIZONA STATE SCHOOLS FOR THE DEAF AND THE BLIND".

Sec. 2. Title 15, chapter 11, article 1, Arizona Revised Statutes, is amended by adding section 15-1306, to read:

START_STATUTE15-1306. Arizona state schools for the deaf and the blind; local education agency

Notwithstanding any other provision of this chapter or chapter 10, article 7 of this title, The Arizona state schools for the deaf and the blind campuses are considered local education agencies for the following purposes:

1. Federal education funding received by this state.

2. State and federal accountability, including reporting requirements.

3. Providing a free and appropriate public education to enrolled pupils pursuant to the individuals with disabilities education act (20 united states code chapter 33), including Procedural safeguards, complaint procedures, implementation of individualized education programs and reevaluations pursuant to chapter 7, article 4 of this title.

4. Graduation criteria and procedures, including diplomas and transcripts. END_STATUTE

Sec. 3. Legislative intent

The intent of section 15-1306, Arizona Revised Statutes, as added by this act, is to recognize the Arizona state schools for the deaf and blind campuses as the local education agencies responsible for providing a free and appropriate public education for enrolled pupils, while maintaining the home school district as a resource for the pupil's individualized education program team.  The legislature recognizes that the board of directors for the Arizona state schools for the deaf and blind is currently working on a strategic plan.  Once the strategic plan is complete, the legislature may need to readdress the current structure to ensure that the legislature aligns with the strategic plan and purpose of the Arizona state schools for the deaf and blind in order to address the best interests of enrolled pupils.

Sec. 4. Arizona state schools for the deaf and the blind; district of responsibility; exception

Notwithstanding title 15, chapter 11, Arizona Revised Statutes, for the 2021-2022 school year the Arizona state schools for the deaf and blind shall be a district of responsibility and local education agency for pupils served through a campus-based model and shall be responsible for providing a free and appropriate public education, awarding diplomas and submitting data for federal and state accountability purposes, except that the school district or charter school in which the student previously attended prior to enrolling in an Arizona state schools for the deaf and blind campus-based model or, if the student has moved, the school district or charter school in which the student intends to attend, shall enroll a student if an individualized education program determination is made that the Arizona state schools for the deaf and blind is no longer the least restrictive environment. If the Arizona state schools for the deaf and blind convenes a meeting of a student’s individualized education program team to determine a student’s placement status, the Arizona state schools for the deaf and blind shall invite a representative of the school district or charter school in which the student will next attend to participate in the meeting.
